Terms of Service
These terms govern your use of Wabizo, a WhatsApp ordering and automation product operated by Expertizo ("we", "us"). By creating an account or using the service, you agree to them.
The service
Wabizo connects to your WhatsApp Business account and automates order taking, catalog browsing, customer replies, and related functions. Specific features depend on the plan you subscribe to.
Eligibility and accounts
You must be operating a legitimate business and be authorised to act for it. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.
Your responsibilities to your customers
This section matters more than any other. When you use Wabizo, you agree that:
- You have obtained valid opt-in consent from every customer you message, as required by the WhatsApp Business Messaging Policy.
- You will not use Wabizo to send unsolicited bulk messages, spam, or content unrelated to the customer's request.
- You are the data controller for your customers' information and are responsible for having your own privacy notice.
- You will comply with all laws applicable to your business, including consumer protection and, where relevant, rules governing regulated goods such as pharmaceuticals.
Violating WhatsApp's policies can get your number banned by Meta. That decision is Meta's, not ours, and we cannot reverse it.
Acceptable use
You may not use Wabizo to:
- Break the law, or facilitate the sale of goods you are not licensed to sell
- Impersonate another business or person
- Attempt to gain unauthorised access to our systems or another customer's data
- Reverse engineer, resell, or white-label the service except where your plan expressly permits it
- Send malware, or interfere with the operation of the service
Third-party dependencies
Wabizo depends on the WhatsApp Business API operated by Meta. Your use is also subject to Meta's terms. We are not responsible for outages, policy changes, pricing changes, or account actions taken by Meta, and such events do not constitute a failure of our service.
Fees, trials, and billing
Paid plans are billed in advance on a recurring basis. Free trials convert to paid subscriptions unless cancelled before the trial ends. Fees are exclusive of taxes unless stated. We may change pricing with reasonable notice; changes take effect at your next billing cycle. Except where required by law, fees already paid are non-refundable.
Cancellation and termination
You may cancel at any time, effective at the end of your current billing period. We may suspend or terminate an account that breaches these terms, creates risk to the service, or is used unlawfully. We will give notice where it is reasonable to do so.
Intellectual property
We retain all rights in the Wabizo software, branding, and documentation. You retain all rights in your catalog, content, and customer data. You grant us only the licence needed to operate the service for you.
Availability and disclaimers
We work to keep Wabizo running reliably but do not warrant uninterrupted or error-free operation. Except where a service level agreement is expressly included in your plan, the service is provided "as is" without warranties of any kind, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, including lost profits or lost business. Our total liability for any claim is limited to the fees you paid us in the three months preceding the event giving rise to the claim.
Changes to these terms
We may update these terms. We will change the date at the top of this page and, for material changes, notify account holders directly. Continuing to use the service after changes take effect means you accept them.
Governing law
These terms are governed by the laws of the Islamic Republic of Pakistan, and the courts of Karachi have exclusive jurisdiction over any dispute.
